• _ !y ~ • • <br />B) The Parkdale Pit, file #M-86-011. as was stated in a <br />letter dated December 5, 1989 and again in a letter <br />dated July 15, 1992, this site was never occupied by <br />Fremont County. The site was located on Bureau of Land <br />Management property. The Bureau found out that prior <br />mining rights existed for the site and therefore <br />revoked the free use permit issued to Fremont County <br />before Fremont County occupied the site. Fremont <br />County would certainly appreciate your agency removing <br />this pit from your active files. <br />C) The Fremont County Eightmile Park Pit (Dixon). file ~M- <br />90-139, was never mined by Fremont County. This site <br />was found by your agency to be an illegal operation by <br />Mr. Tom Dixon located on State Board of Land <br />Commissioners property. Fremont County took over the <br />lease but had neighborhood opposition to having a County <br />gravel pit on the site and therefore the County never <br />mined the site. Since permits were issued by your <br />agency to Fremont County; your agency decided to hold <br />Fremont County responsible for reclamation of Mr. <br />Dixon's gravel pit. As per the "Joint Motion for <br />Approval of Reclamation Plan and Schedule" the <br />reclamation grading was completed on September 19, 1991 <br />and the seeding, fertilization and mulching completed <br />November 14, 1991. Your agency was notified of these <br />circumstances by letters {with accompanying photographs) <br />dated October 2, 1991 and January 3, 1992 respectively. <br />In the letter dated January 3, 1992, Fremont County <br />requested release of the performance warranty for this <br />pit. Since Fremont County never mined the site and <br />reclamation obligations have been met, the Board of <br />County Commissioners do not feel an annual fee should be <br />required.
