._~, <br />RULE 2.04.13(1) (a-f) <br />Revised 12/6/02 <br />C-81-019 <br />ARR <br />The species of plants seeded on Colowyo's 2002 reclamation areas follow the approved seed <br />mixture located in Volume 1, page 2.05-44 through 2.05-45. _ Seed was purchased from Wind <br />River Seed and a copy of the seed tag is included in Exhibit 6. The seed mixes identified in the <br />invoice were used for 2001 reclamation. A map detailing the areas which topsoil was laid down <br />and seeded is presented in Exhibit 7 of the ARR. <br />The Division regulations contain consistent themes that mine operations and reclamation are to <br />be conducted in such a way as to minimize adverse environmental impacts and ensure that <br />reclaimed lands will support the approved postmining land use. The Division may take an <br />enforcement action using a number of Rules if the Division determines that an operator has not <br />met the commitments of an approved weed management plan or the Division determines a <br />noxious weed infestation displays an increasing trend, due to a lack of effort by the operator. <br />Colowyo applied pesticides to the land for the control of known weed species. Chemicals <br />applied within the mine permit boundary include: Tordon, 2,4-D, and Roundup. <br />RULE 2.04.13(2) <br />Colowyo submits fill reports for the Streeter Fill, the West Pit Fill and the Section 16 Fill. The <br />requirement to submit the Streeter Fill reports is located on page 4.09-2 of the mine permit. The <br />completed 2001 reports are located in Exhibit 9 of this report. The requirement to submit the <br />West Pit Fill reports is located in Volume 5B of the mine permit, Exhibit 19, page I a-4. The <br />completed 2002 West Pit Fill reports are located in Exhibit 10 of this report. The requirement to <br />submit the Section 16 Fill reports is located in Volume 56 of the mine permit, Exhibit 19, page II <br />a-4. The completed fill reports are located in Exhibit 11 of this report. <br />Sampling of regraded overburden is pertormed at a density of one sample per five acres of <br />regraded area (PAP Exhibit 6, Item #4, Colowyo letter of January 4, 1983). Colowyo recognizes <br />the potential for elevated SAR values (PAP page 2.04.6-9). Threshold SAR values for special <br />handling are identified as "suspect levels". The SAR "suspect level" at Colowyo is 15 (PAP, <br />Exhibit 6, Item #4, Colowyo letter of January 4, 1983). Remedial measures consist of <br />additional samples to determine the extent of the suspect material (PAP, Exhibit 6, Item #4, <br />Colowyo letter of January 4, 1983). If the aerial extent is greater than one acre, it was once to <br />be covered with at least five feet of acceptable material. This requirement was reduced to 18 <br />inches of topsoil cover (PAP, Exhibit 6, Item #4, Division letter of January 24, 1983). <br />Colowyo sampled 18 locations of regraded overburden during 2001. One sample exhibited <br />SAR levels over 15. The Division was made award of this elevated SAR level during the <br />November 27, 2002 on-site inspection and followed-up with Colowyo in a November 30, 2001 <br />correspondence letter. The letter and regraded overburden sampling results is located in <br />Exhibit 12 of this ARR. <br />The Revegetation Monitoring Report was prepared by ESCO Associates of Boulder, Colorado <br />and is located in Exhibit 13 of this ARR. <br />Page 1 of 1 <br />CF 4.3.1 <br />
