Kiger August 17, 1994 <br />WEST PIT EXCESS SPOIL FILL CONSTRUCTION UPDATE AND CERTIFICATION <br />On August 16, 1994, I inspected the area in which the West Pit <br />Excess Spoil Fill shall be constructed. The purpose of this <br />inspection was to observe whether all topsoil and organic material <br />had been removed from the excess spoil fill location, and to <br />satisfy the requirements of CDMG Rule 4.09.1(lla). <br />During the inspection it was observed that all topsoil and <br />organic material had been removed from the area of the West Pit <br />Excess Spoil Fill. The majority of the topsoil and organic <br />material has been removed for approximately two weeks, however one <br />small corner on the north east side of the fill remained to be <br />brushed. This was accomplished using a D10N dozer and a D9L dozer <br />on Tuesday morning, August 16, 1994. The remaining topsoil and <br />organic materials had been removed using 627B and 637E Caterpillar <br />Scrapers during the Months of June and July, 1994. <br />I am a mining engineer, registered in the State of Colorado, <br />and experienced in the removal of topsoil and organic material for <br />the purposes of mining activities. <br />To the best of my knowledge, based on my professional <br />expertise the West Pit Excess Spoil Fill has thus far been <br />constructed in conformance with the prudent state-of-the-art for <br />earth and rock fill topsoil and organic material removal <br />construction, as specified in pages Ia-2 through Ia-4, Exhibit <br />19Ib, and other applicable requirements of the approved permit <br />documents, a portion of CDMG Permit C-81-019. <br />hen R.
