<br /> <br />condition of cultural resource approval for the 1984 Permit <br />Revision Application by OSM then it is believed that all <br />cultural resource requirements attending CWI's 1984 Revised <br />Permit Application will have been met (Baker 1984:91). <br />Submission of the above recommendation was Centuries' last action <br />relative to Colorado Westmoreland's cultural resource planning needs <br />until late in 1985 when the firm was asked to prepare this report. <br />Subsequent to completion of the 1984 baseline report (Baker 1984), <br />Colorado Westmoreland summarized the cultural resource findings and <br />commented on potential impacts in it's application for an operating <br />permit (Colorado Westmoreland 1984). In that document, Westmoreland <br />suggested that there would be no direct impacts by the Orchard Valley <br />Mine operation on any National Register eligible resources. <br />The Office of Surface Mining and Colorado Mined Land Reclamation <br />Board, in consultation with the State Historic Preservation Officer, <br />reviewed Centuries' report (Baker 1984). Centuries Research has been <br />unable to obtain information relative to that review. In September of <br />1985, however, Colorado Westmoreland received its approval of its mining <br />plan (Office of Surface Mining 1985). There were three special <br />conditions attached to that plan. The first two dealt with concerns of <br />the U.S. Fish and Wildlife Service. The third condition related to <br />cultural resources and stated: <br />Special Condition 3: Within 90 days of mining plan <br />modification approval, the lessee/ <br />operator shall submit to OSM and <br />Colorado MLRD for approval a <br />contingency plan to protect <br />archaeological site DT700 in the <br />event subsidence may affect this <br />site. This plan shall include <br />criteria for triggering <br />implementation of the approved <br />protective or mitigative measures <br />(Office of Surface Mining 1985). <br />Completion of a contingency plan relative to one site, 5DT700, as <br />spelled out in special conditon "3" constituted the scope-of-work for <br />the present project. <br />- 2- <br />
