I return the following comments for your consideration <br />in responding to the applicant. <br />Coal Processing Waste Bank Inspection Letter: <br />In general, the inspection form contains insufficient detail. The items <br />selected by the operator to be included in the form are each appropriate, but <br />they do not fulfill the overall requirements of Sections 4.10.2 and <br />4.09.1(11), included by reference by Rule 4.10. Further, the format of the <br />inspection report form does not provide sufficient background information to <br />support the preparer's observations (see attached letter, Dave Shelton to all <br />operators, dated July 13, 1984). <br />Railroad Fill Slooe Sediment Pond Calculations: <br />Providing that the appropriate hydrologic specialist concurs with the <br />operator's pond sizing projections, the certification document appears <br />sufficient to certify that the pond was constructed as depicted in the <br />attached as-built drawings. I am assuming that we have a set of original <br />drawings with original signatures. <br />As-built Drawings of Access and Haul Roads: <br />The purpose of the certification of roads is to attest that the roads were <br />built as approved. Therefore, this letter is not sufficient. I am assuming <br />that the drawings, which I have not personally examined, are each properly <br />stamped, signed, and carry a certification statement, stating that they <br />properly depict the actual as-built situation of the various roads. However, <br />Chief Engineer Weigrand's letter should clearly certify that the "as-built" <br />configuration of the roads conforms with the approved configuration or, if <br />they do not, it should clearly describe why they do not and refer to any <br />appropriate amendments. <br />Attahcments <br />/wjh <br />7426E <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
