Rule 4.09.1(11) Inspection
Rule 4.09. I (11)(a) The fill shall be inspected for stability by a registered engineer or other
qualified professional specialist experienced in construction of earth and rockfill embankments
under the direction of a qualified professional engineer at least quarterly) throughout the
construction and during the following critical construction periods2: (1)removal of all organic
material and topsoil, (2)placement ofunderdrainage systems, (3) installation of surface drainage
systems, (4) placement and compaction of fill materials, and (5) revegetation.
The permittee is in compliance with this rule. 'This is a quarterly report. A registered engineer
accomplished both the inspection and certification. 2 No critical construction period was
encountered during this period. A requirement to complete a surface drain was noted.
Rule 4.09.1(1 I)(b) The qualifed registered engineer shall provide to the Division a certified
report within 2 weeks after each inspection) that the fill has been constructed as specified in the
design approved by the Division. 2The report shall include a description of any appearances of
instability, structural weakness, and other hazardous conditions observed during the inspection.
A copy of the report shall be retained at the mine site.
The certification indicates that the fill was inspected on November 3, 2004. The report was to be
provided to the Division by November 17, 2004 (within two weeks after the inspection, PAP,
Exhibit ] 9, Section I, page Ia-4). The report was submitted on a letter of November 11, 2004 and
received at the Division on November 12, 2004. 2 The report included observations on instability,
structural weakness and other hazazdous conditions. There were no problems with the fill.
