Accord <br />7541 Weld County Road 26-3/4 <br />Longmont, CO 80501 <br />Dear Mr. Accord: <br />It is our understanding that we have reached an agreement as <br />outlined in this letter. If this letter stat_s the agreement <br />correctly, please sign the enclosed copy and return it to us. We <br />will then Have the easements prepared by our attorney. <br />1. It is our understanding drat we are to grant you a non- <br />exclusive easement for the purpose of carrying water to your <br />real property from the Last Chance Ditch, over our real <br />property whic}r lies in the West half of Section 32, Township <br />3 North, Range 67 west of the 6th P.M., Weld County, Colorado, <br />through a lateral ditch, and for a roadway to maintain the <br />same,along the west ditc}r alignment from the ]readgate to <br />County Road 26 and 3/4, 30 feet in width, extending ten feet <br />from the centerline of the ditch eastward, and 20 feet from <br />the centerline of the ditch westward. We will also provide a <br />30 foot non-exclusive easement for a new ditch from the <br />existing west delivery point all the way east to the east <br />delivery point. 7']ris latter 30 foot easement would lie just <br />inside our north property line. The foregoing easement shall <br />be subject to t}re prior easement for the Sinclair Pipeline <br />which was recorded on October 23, 1963, under Reception No. <br />1419698 in the Weld County Real Estate Records. <br />2. Any portion of t11e above described ditch that remains in its <br />current alignment will remain as is, without further <br />improvement. Any portion reconstructed in a new alignment <br />along County Road 26 -3/4 will be either cement lined or placed <br />i.n a concrete pipeline at our sole discretion. T}1e new cement <br />lined or piped ditch will be constructed to handle t}re water <br />capacity which you currently need. <br />3.
