Box 165
La Veta, Colorado 81055
RE: Rocky Flat Gravel - File No. 82-129
Dear Mr. Goemmer:
I have recently returned to work after an illness and received your request
for a technical revision from Mike Stanton. I have several questions and
comments about this technical revision that should be resolved before it
can be heard by our Board.
To date, I have not received a signed, notarized copy of the pettnit back
from you as was requested in my letter of August 5, 1982 (when two permit
copies were sent to you). Please return this to our Division as soon as
possible.
The areas you have outlined for "cement batch plant", "stockpile area"
and "asphalt plant" all lie partially or entirely outside of the 7.5 acres
that was finally approved as the permit area. All activities connected
with the operation must occur within the permit area.
I have enclosed a copy of your final map of the permit area. I suggest
two options to you to correct this matter. You could move all of these
areas to within the 7.5 permitted acres and show them on this map (and
return it to me). The other option is to amend the permit (by as much
as 2.4 acres) such that the planned new activities are within the new,
expanded permit area. This would entail submission of a new map and any
other necessary new information. A fee of $25„00 plus $10.00 per acre
of part thereof added would also be required. Furthermore, 2 weeks of
publication in a local newspaper would be required (as was done for the
original permit application). Any new areas added would be required to
be reclaimed as per the performance standards described in Rule 6.
