Simpson, Assistant State Engineer <br />SUBJECT: Siegrist Construction Company - Siegrist Construction Company Sand <br />and Gravel Pit, q82-15, Application for Mining and Reclamation Permit <br />As requested, we have reviewed the above referenced application. The application <br />indicates that the reclaimed ponds will be used for recreation. Using an impound- <br />ment of water for recreational purposes has been defined, in CRS 1973, 37-90-103, <br />as putting the water to beneficial use. A well is defined as any structure or <br />device which is used for the purpose of obtaining ground water for beneficial <br />use from an aquifer. Since the source of water for the lake that will be formed <br />by the gravel pit operation is ground water, we consider the lake to be a "well". <br />Prior to construction of a "well", a well permit must be obtained by the appli- <br />cant to avoid being in violation of CRS 1973, 37-90-137. <br />The well permit application form shown in exhibit DD of the gravel mining appli- <br />cation is for dust control. Before submitting this well permit application to <br />our office, Siegrist Companies should revise the application to include recrea- <br />tional purposes. The consumption information specified on the application should <br />be increased to reflect the evaporation from the reclaimed lakes. <br />The proposed well would be located within the over-appropriated South Platte <br />River basin. Therefore, before any well permit could be issued, Siegrist Com- <br />panies would have to develop a plan to augment (replace) any additional stream <br />consumption due to the gravel pit operation. The augmentation plan would have <br />to be approved by the Division Water Court before the well permit could be issued. <br />Our office is also concerned about injury to Hayseed Ditch, Last Chance Ditch, <br />adjacent ponds, and nearby wells due to dewatering operations. We feel a monitor- <br />ing system should be Set up to provide data to support or contradict any injury <br />claims which may occur from this operation. <br />St. Vrain and Left Hand Ditch Water Conservancy District has expressed concern <br />that increased development will reduce the quality and quantity of water avail- <br />able in the area.
