Long Division Director Pemri[ Date: November 9, 2001 (Anniversary date for annual report and fees Purposes) THIS PERMIT is issued by the Mined Land Reclamation Board, Department of Natural Resources, State of Colorado. RECITALS A. The Permittee, Elbert County, desires to conduct a mining operation lmown as Belveal Gravel Pit, for the purpose of extracting Gravel. The Permittee will not mine any secondary corrunodities at this site. B. On October 19, 2001 the Mined Land Reclamation Board (the "Board") approved the Pemuttee's application for this permit and directed that this permit be issued upon the filing with the Division of Minerals and Geology (the "Division") of performance warranty approved by the Division. Said warranty has been filed with the Division. C. ffthe Permittee desires w extract materials other than those listed in (A), a s~arate pemrit may be required. D. On October 19, 2001 the Board made the following findings: 1. The apphcation for this permit complies with the requiremerrts of the Colorado Mined Land Reclamation Ad for the Extraction of C~rstrudiOR Materials, C.RS. 34-32.5-101 et sue., as amended, and with all applicable local, state and federal laws; 2- The operation will nd adversely affect the stability of any significant, valuable, and pemrarrent man-made structure located within two hundred feet of the Affected Land, except where there is an agreement between the Operator and the persons having an irrterest in the structure that damage to the structure is to be compensated for by the Pemiittee; and;
