Dept. of Natural Resources <br />IN THE MATTER OF THE APPLICATION OF ANDESITE ROCK COMPANY <br />FILE NUMBER 77-141 <br />PROTEST AND PETITION FOR HEARING OF HALLYN F. HALL, Landowner <br />Hallyn F. Hall, Landowner, hereby protests the application of Andesite <br />Rock Company, and requests a hearing be held thereon, as follows: <br />1. On Item 6 of the Board's application form, no parent corporation is <br />specified. Landowner is informed and believes that Andesite Rock Company <br />(Operator) does have a parent corporation. <br />2. On Item 10 of the Board's application form, Landowner is informed <br />and believes that Operator crushes and sells overburden, in addition to <br />quartz monzonite. <br />3. The Landowner questions whether the application fee has been <br />properly computed in Item 14. <br />4. The Landowner believes the present land use in Item 15 should be <br />Mining and Agriculture. <br />5. Surrounding land use in Item 16 includes residential, cattle range, <br />cattle pasture and hay meadow. <br />6. In Item 17, future land use should include cattle range, cattle <br />pasture and hay meadow. <br />7. Landowner believes some of applicant's activities outside of the <br />existing 27-acre area permitted by the Board may be properly designated as <br />unpermitted mining operations in Item 16. See Item 9(c) below. <br />8. Exhibit A. <br />The Legal Description is a description of land covered by a lease <br />under which Operator commenced its operation. The legal deacription covers <br />an area of 320 acres, which is not the acreage permitted by the Board, either <br />as presently issued or as applied for. <br />9. Exhibit C. <br />(a) Other individuals not identified, are surface owners of land <br />adjacent to the 320-acre area. See comments to Exhibit P. <br />-1- <br />
