COLORADO DEPARTMENT OF IiEALTN, R'atcr Quality Control Division
Rationale -Page 5. Permit No. COGStX10rb
V. TERMS AND CONDITIONS OF PERMIT
• respectively, in order to daermine rompliancr with the limits. Since the TSS monitoring frequency is
monthly, a TSS limit of 60 mg/1 was added so that rompliance mold be determined based on erne sample.
the Division has amended the defrnitians jot a 30 day average or 7 day amage, ro be determined by the
arifhmuic mean of all samples rolkcted during a 30 day or 7 day period Therefore, the need jot a
daily maumum TSS limit has lraen eliminated, and so is nor included in this renewal permit. The other
TSS dmiu shall ronain the same, jot the appAcnbk raaregories.
e Phosphorus• ?Ire previaur permit inchded Phosphorus (PJ monitoring for the Dillon Rerersnir drainage
area only. This has bwr dwrtged to also include Cherry Credo basin, Bear Cnek basin and those state
waters tributary to Chatfuld Rererwir downsnrmn of the USGS gage at Waterton and on Pbtm Creek
These segments all halve or will have P limits on disrirarges. In general, the typer of jacilitier rovrred
under this permit an rot espccted to bast problems with P; however, monitoring wiU be required on a
quarterly basic jot aU process water discharges to these basins. If the data indicate any potential
problems with P levels at a specific facility, then an individual pnnrit with P limits may be required for
that facility.
d. Grophiu: In the case of graphite mining, the federal ejjluent guideliner (40 CFR 436.382) roll for a
limit far Total Iron. Since the Division has Water Quality Standards in moray arras of the state which
may be stricter than the federal limits, rosrrage of process water disdrargrs from this type of facility
must be under an individual permit.
B. Stormwater Drseharres
. 1. Stormwater vs. Process water
When stormwater mines with process water, the protxss water limitations (Part I.B of the permit) apply to the
drscharge of that mined water. Tire rtormwaftr section (Part LC of the pantitJ is intended ro ros+er those
portions of a nonmetallic minerals production operation (acrpt Joel) that are not already subject to ejjluenr
limitations under 40 CFR 436, and to rotier stotmwattr runofffrom asphalt and ronercte batch plants.
2. Stormwater Manaeemem Plan /SR'MP)
The stormwater ngulationr primarily apply ro areas not rovrrcd by 40 CFR Part 436. They require perminees
to develop and impkmem a Stormwater Managanent Plan (SA'MPJ to protect the quality ojstarmwarer leaving
the silo. The plan shall ident~ potential rouras ojpollution (including sediment) which may reasonably be
etpected to affect the quality of stormwattr disdrarges associated with mining activity. In addition, the plan
shall describe the best managanenr practicer (BMPsJ whidr will be used to reduce the pollutants in stormwater
disdwrges from the mining silo.
Some activities required railer tlu SR'MP may already be in plate. However, the SWMP will require rho
permitree to inordinate these activities with any necessary new activities in an orderly manner, so that the
reruk is the reduction or elimination of pollruams reaching state wafers from areas not limited by e~(jluem
)imitations. Facilities mrts7 implement the provisions of the SWMP nquind under this part as a condition
of this permit.
It is the permittee's responsibility to rots the Colorado Division of Mining and Geology (formerly the
Colorado Mired Land Reclamation Division) of any sign~ront ctwnger of their site resulting from the
implementation of the SWMP. Thrs is so that the Division of Mining and Geology may review the SWMP a~
• inrorporafe any potential revisions into the futility s reclamation permit which might !x needed
Tire SWMP shall include the following items, at a minimum:
