Sevtre Property Damage: Substantial physical damage to property at the treatment facilities which causes them <br />to become inoperable, or substantial and pemtanent loss of natural resources which can reasonably be expected <br />to occur in the absm« of ^ bypass. It does not mem economic loss caused by delays in production. <br />a. Spill: An unintentional release of solid or liquid material which tray cattse pollution of state waters. <br />d. Upset: An exceptional incident in which there is uttintentiottal and tetnporary noncomplian« with permit <br />effluent limitations because of factors beyond the reasonable control of the permittee. An upset does not include <br />noncomplian« to the extent caused by operational error. improperly designed treatment facilities, ittedequate <br />trratmmt facilities, lack of preventative maintenan«, or careless m itr~rtrper operation. <br />Noncomnlitmce Notifi®tioo <br />a. If. for nay reason, the permitter does not cotttply with or will be unable to comply with any discharge <br />limitations or standards specified in this permit, the permittee shall, at a minimum, provide the Water Quality <br />Control Division cad EPA with the following information: <br />1) A description of the discharge and cause of noncomptiaa«; <br />2) The period of noncotnplian«, including exact dates and times and/or the anticipated time when the <br />discharge will return to co>~tlim«; and <br />3) Steps being taken to reduce, eliminate, and prevent renurea« of the noncomplying discharge. <br />b. The permittoe shall report the following instances of nonenmplian« orally within twenty-four (241 hours from <br />the time the permittx becomes aware of the noncomplian«, and shall mail to the Division a written report <br />within five (Sl days after becoming aware: of the noncompliaa«: <br />1) Any inatan« of noncotuplian« which may endanger health or the environment; <br />2) Any uaantieipated bypass; <br />3) Aay upset which canoes m exceedan« of any effluent limitation in the permit; <br />4) Any spill which causes any effluent limitation to be violated; <br />5) Daily maximum violations for any toxic pollutants or harardous substances limited by Part I.B of this <br />permit and specified as requiring 24 hour aotificatioo. <br />c. The permittee shall report all other instmcee of non-complim« not tnquiting 24-hero notification at the time <br />Discharge Monitoring Reports are submitted. The reports shall contain the information listed in sub-paragraph <br />(a) of this section. <br />4. Submission of Incorrect or Inmmolete Information <br />Where the perttrittee failed to submit any relevant facts in a permit appli«tioo, or submitted incorrect information in a <br />permit appli«tioo or report to the Division, the permittee shall promptly submit the relevant application information <br />which was not submitted or any additional information needed to correct any erroneous information previously <br />. submitted. <br />5.
