<br />E. Use: The Subject Water Rights are decreed for <br />irrigation purposes. <br />F. Historic Use: The Subject Water Rights were <br />historically used to irrigate land in Weld County, Colorado. <br />(a) A map showing the location of the Fulton Ditch is <br />attached hereto as Exhibit A. A summary of records of actual <br />diversions for the Fulton Ditch is attached hereto as Exhibit B. <br />The average annual diversions per share of Fulton Irrigating <br />Ditch Company water is 3.5601, or 21.36 acre feet associated with <br />applicant's 6 shares. Total annual depletions to the stream <br />attributable to applicant's shares in the Fulton Irrigating Ditch <br />Company are 12.06 acre feet. <br />(b) Baumgartner Well No. 1-6291 has historically been <br />used to irrigate 132 acres in the E1/2 of the W1/2 and the W1/2 <br />of the E1/2 of Section 30 and the N1/2 of the NE1/4 of the NW1/4 <br />of Section 31, both sections lying in T. 1 N., R. 66 W. of the <br />6th P.M., Weld County, Colorado. <br />(c) Baumgartner Well No. 2-6293 has historically been <br />used to irrigate 28 acres in the E1/2 of the E1/2 of the SE1/4 of <br />Section 30, T. 1 N., R. 66 W. of the 6th P.M., Weld County, <br />Colorado. <br />4. P:rooosed Chance: <br />(.s) Applicant seeks the following changes with respect to <br />the Subject Water Rights: <br />(1) a change in use from irrigation to municipal, <br />domestic, industrial, mining, dust suppression, reclamation, <br />irrigation, recreational and piscatorial purposes; <br />(2) a change from direct flow and underground water <br />rights to storage in Platte Valley Lake Nos. 1 and 2 described <br />more fully in Section II, paragraph 3, below; <br />(3) an alternate point of diversion for the Subject <br />Water Rights located adjacent to the South Platte River at a <br />point whence the Southwest corner of Section 30, T. 1 N., <br />R. 66 1~I. of the 6th P.M., Weld County, Colorado, bears S68° 12' <br />West a distance of 1,885 feet (the °Platte Valley Infiltration <br />Gallery°). <br />(b) Applicant will install and maintain such measuring <br />devices and implement such accounting procedures as may be <br />reasonably required by the Division Engineer to verify that the <br />amounts consumed pursuant to the subject change of water rights <br />equals historic depletions to the stream. <br />-3- <br />
