A copy bf Mr. Watdron's Apri119, 2001 Inspection Repcrt is attached hereto as Exhibit D. <br />On September 15, 2005, Ms. Pickford conducted a second inspection of the Ansley Pit #2 site. Ms. <br />Pickford found that "The majority of the pit contains exposed groundwater ...The permit for this <br />site does not include parameters for the exposure of groundwater. This problem was cited in the <br />previous inspection report dated April 19, 2001, and the problem was not resolved. The Division <br />is not awaze of the operator receiving the proper cleazance and permits with the Office of the State <br />Engineer to allow for exposure of groundwater." A copy of Ms. Pickford's September 15, 1995 <br />Inspection Report is attached hereto. as Exhibit E. On April 4, 2006, the County responded to <br />DMG's concerns on the Ansley Pit #2 and stated that "Park County is in processing of an <br />augmentation plan and supplemental water supply plan." A copy of the County's response is <br />attached hereto as Exhibit E. <br />The Ansley Pit #2 is immediately adjacent to the proposed Allen mining site. Applicant, <br />Allen Drilling and Excavating Co., Inc has also stated that it plans to excavate down to <br />approximately 10 feet.and claims the excavation will not expose groundwater. Based on the Ansley <br />Pit #2, it is very likely the proposed Allen Pit mining operation will expose groundwater. Therefore, <br />Objectors ask that the Office of the State Engineer provide a response to the Allen Pit permit <br />application and, in doing so, consider the following as a condition for approval of this application: <br />"If the proposed Allen Pit mining operation exposes groundwater, the applicant will need to obtairi <br />either a gravel pit or other type of well permit, as applicable. However, prior to obtaining a permit, <br />an approved water supply plan or decreed plan for augmentation is required. The applicant must <br />also show that no injury to other vested water rights will occur as a result of this gravel pit project." <br />Thank you for youi time and prompt consideration in this matter.
