Overhead Power Transmission Lines, owned by San Miguel Power Company cross over the <br /> north portion of the permit area from west to east. Two sets of power poles lie within the north <br /> ridge excavation area, and are to be avoided during operations there. A damage reimbursement <br /> agreement is attached hereto as Exhibit S-a. <br /> 2. Underground Telephone Cable, owned by Nucla--Naturita Telephone Company crosses from <br /> northwest to southeast at 53 feet southwest of(outside) the southwest comer of the permit area. <br /> A damage reimbursement agreement is attached hereto as Exhibit S-b. <br /> 3. West Boundary Fence, owned by applicant, Weimer Ranches, is planned for removal and re- <br /> location in the Mining Plan and therefore is included in the financial and performance warranties <br /> for the mining operation. A damage reimbursement agreement, as a part of the Montrose <br /> County set-back exemption authorization, is attached hereto as Exhibit S-c <br /> 4. South Fence & County Road, owned by Montrose County Port Authority, is more than 200 feet <br /> distant from excavation operations and a damage reimbursement agreement, as a part of the <br /> Montrose County set-back exemption authorization, is attached hereto as Exhibit S-d. <br /> No other structures occur within 200 feet of the site. <br /> Adjacent Property Ownership, to the west owned by USDI Bureau of Land Management, and to the <br /> south, (Montrose County Port Authority), lie within 25 feet of topsoil stockpile operations, thus <br /> requiring written authorization for Montrose County Land Use "mitigation standards", per Montrose <br /> County Zoning Resolution Section XH-1-b-(I). Such authorizations from Montrose County and <br /> Bureau of Land Management are a part of the hereto attached Exhibits S-c and S-d, respectively. <br /> 36 <br />
