<br />desires to conduct a(n) open mini^g
<br />vent Valley for tae purpose of extracting open
<br />WHEZF,~.S, on February 25 19 80, RON EBBERTS "FILED" an
<br />applicatioa,a reclamation plan aad map, and the required fee, as required by Law; and
<br />WHEREAS, on March 6 14 80, the `tined Land Reclamation Board approved
<br />RON EBBERTS a~plicatioa aad set bondl aad_ _,
<br />WBE.gF2.S, on October 1 19 80, the :tined Laad Reclamation Board accepted
<br />surety submitted by RON EBBERTS and such date shall be considered the
<br />date of issuance of the permit and the anniversary date for all other purposes; and
<br />WHERE.45, the :tined Laad Reclamation Board has made a finding, for ehe purposes
<br />of issuing this permit, that:
<br />1) the application complies with the requirements of the Colorado
<br />`*iaed Land Reclamation Act and all applicable local, state aad
<br />Federal laws; and,
<br />2) the operation will not adversely affect the stability of any
<br />significant, valuable, and permanent man-made structures located
<br />within two hundred feet of the affected land, except where there
<br />is an agreement between the operator and the persons having an
<br />interest is the structure that damage to the structure is to be
<br />compensated for by the operator; and,
<br />3) the proposed mining operations and reclamation can be carried out
<br />in conformance with the requirements o: C.R.S. 1913, 34-32-116, as
<br />amended (1916 Sess. Lacs :?. B. 1060; and
<br />iJEIERE?.S, for the purposes of issuing this permit, the operator has made a
<br />sacisfaceory showing to the Board that he will employ during and after his
<br />open mining operations procedures reasonably designed to minit:ize
<br />as such as practicable the disruption from the open mining onerac'_ons
<br />and will provide for the rehabilitation of the affected Land chrouga the rehabilitation
<br />of plant cover, soil stability, avatar resources, and other measures appropriate to the
<br />subsequent beneficial use of such mined and reclaiaed lands; and that in tae e•reat
<br />of the failure of his proposed reclamation plan, he a-ill take •ahaee•rer measures %hica
<br />may be necessary in order to assure the success of reclamation of the lands affected
<br />b;~ his open mining operations; and,
<br />!vTIERE.~.S, for the purposes of issuing this Hermit, a cony of tae application
<br />approved by the Wined Land Reclamation Board of the State of Colorado is attacaed
<br />to this permit and thereby becomes a part of the terns hereof.

<br />Land Reclamation Act, Article 32 of Title 34, C.R.S. 1973, as amended, (1976
<br />Sess. Lacrs 3.8. 1065) the ~~ined Land Reclamation Board of the Stara of Colorado
