interest in the structure, that the applicant is to provide compensation for any damage to
the structure; or
(b) Where such an agreement cannot be reached, the applicant shall provide an appropriate
engineering evaluation that demonstrates that such structure shall not be damaged by
activities occurring at the mining operation.
(c) Where such structure is a utility, the Applicant may supply a notarized letter, on utility
letterhead, from the owner(s) of the utility that the mining and reclamation activities, as
proposed, will have "no negative effect" on their utility.
6.5 GEOTECHNICAL STABILITY EXHIBIT
This section may be adequate as submitted. This adequacy determination depends on submission
of additional information on the mining operations requested above, especially as regards permanent man-
made structures.
Per Rule 1.6.5 "Within ten (10) working days after the last publication or as soon thereafter as proof has
been obtained, the Applicant shall mail proof of the publication required by Rule 1.6.2(1)(d) to the
Division", this proof of publication has not yet been received.
Given the extensive nature of the adequacy responses that the applicant will need to provide to the
Division, the Division will require the Applicant to provide a complete revised application once all the
adequacy issues have been addressed.
I look forward to your response. Please allow adequate time for review before the October 9, 2006
decision date. Rule 1.8.1 states that changes and additions to the permit application must be filed with the
Division and the County Clerk and Recorder. The applicant must also provide the Division with an
affidavit or receipt demonstrating that the change or addition was filed with the County Clerk and Recorder
no later than the close of business on the day the change was filed with the Division. If needed, the
Applicant can, at any time, request an extension of the permit decision date.
