groundwater, an amendment to the permit can be submitted to the Division for consideration of <br />increasing the maximum depth of mining. <br />2. The Applicant may change the current application to include pazameters for wet mining at the site, <br />which would include evidence that the Operator is in compliance with OSE regulations pursuant to <br />Section 3.1.6 of the Construction Materials Rules and Regulations. <br />3. The Applicant may postpone application for the permit until one year of groundwater monitoring has <br />been conducted at the site, to include monthly water level measurements, which should indicate to <br />what depth the deposit can safely be excavated, without exposing groundwater. <br />The second issue regarding the Application information pertains to the August 28, 2003 letter from <br />Banks and Gesso indicating that an "engineered containment area for fuels and oil" will be <br />incorporated at the site to protect the area from spills. The specific measure that will be incorporated <br />in this containment area must be specified. At a minimum, berms and liners should be used. <br />Thirdly, the pernut application information indicates that that if Mr. Haldorson decides to recover sand <br />and gravel below the water table, a Temporary Substitute Supply Plan (TSSP) will be submitted and a <br />well permit obtained from SEO. If the Applicant opts to maintain the commitment that the Operator <br />will not expose groundwater during the mining process and wants to include the option to change to <br />wet mining, the Applicant should be aware that in addition to the TSSP and well permit, an <br />amendment to the application will need to be submitted to incorporate the change to the mining plan. <br />Fourth, the groundwater report suggests some options that could be incorporated should down gradient <br />water rights be affected by the operation's activities.
