<br /> <br />The applicant is aware that should any improvements be needed <br />to the ford, then, a 404 Permit will be required and obtained <br />from the U.S. Armv Corps of Engineers. <br />E-1. It has been stated in the application that the adits <br />will be sealed with either a steel grate or backfilling the <br />portal. These plans remain as previously stated. <br />E-2. See Exhibit E and comments in response E-1 of this <br />letter. <br />E-~. At this time mulching will be used only as a last resort <br />to insure seed placement and development. Furrowing the <br />surface along topographic features will prevent downslope <br />erosion, and loss of soil and seed. This will also enhance <br />moisture retention and prevention of windblown loss of seeds. <br />Hay/straw mulch, if needed, will need little <br />stapling tv hold it in place. No, all roads to each mine adit will be barracaded, <br />ripped, graded and reseeded. The road cuts will be graded to <br />blend with the surrounding topography. <br />E-7. A reclamation plan specific to the loadout area will be <br />submitted to MLRD for review and approval should such a site <br />be selected at same future date. <br />F-1. A letter is attached showing that mining at the Incas is <br />compatible with the zoning laws of La Plata County. <br />G-1. The applicant has attached a Mailgram illustrating the <br />agreed upon language for his right to enter and to complete <br />all reclamation activities. <br />H-1. The operator will provide MLRD a copy of the special use <br />permit when issued by the U.S. Forest Service. The <br />application for the special use permit has been submitted to <br />the U.S. Forest Service. Mancos Ranger District for review <br />and consideration. <br />H-2. The haul road is a public road and permission to use it <br />is not required from the adjacent landowners. If any <br />improvements are needed, the adaacent landowners, MLRD, and <br />other appropriate regulatory agencies will be notified of the <br />
