Schreiner, Reclamation Specialist <br />RE: File No. M-90-140 <br />Adequacy Items <br />The following items must be addressed by the applicant in order to satisfy the <br />applicable requirements of C.R.S. 34-32-101 et seq, and the i1ineral Rules and <br />Regulations of the i'lined Land Reclamation Board` <br />1. The Mined Land Reclamation Act 34-32-1-1-et. seq., C.R.S. 1973 <br />requires that a buffer zone of 200 feet be implemented around <br />all permanent man-made structures during mining operations, <br />except where there is an agreement between the operator and <br />the persons having an interest in the structure that damage <br />to the structure is to be compensated for by the operator. <br />As an alternative, the applicant mist demonstrate that <br />operations within 200 feet will not adversely impact these <br />structures . <br />Please address how compliance with the Act will be achieved for the powerline <br />and powerline right of way which belongs to the Bureau of Reclamation, and the <br />fenceline and reclaimed gravel pit which belong to the Estey Family Trust. <br />TAS/eke <br />1878E <br />
