The property known as Gunners Mark Park Pit <br />was acquired in 1977 by Mobile Premix Concrete, Inc. from <br />Consolidated Rock Company after the demise of the latter <br />company. The pit name has been changed to the Howe Pit. <br />Consolidated Rock Company ("Conrock") operated the pit <br />under a 1973 permit (No. 73-5) from October 1974 until <br />August 1976 when county officials became aware that mining <br />by Conrock had moved off the zoned and permitted land. The <br />county directed Conrock to cease operating the pit until <br />proper zoning was obtained. No action was taken by the <br />Mined Land Reclamation Board, although staff of the assistant <br />attorney general's office and the Mined Land Reclamation Div- <br />ision monitored Conroclc's operations and were aware of its <br />failure to convert and update its 1973 permit to a 1976 per- <br />mit. An application dated October 1976 prepared for <br />Conrock by Roman V. Bockus, A.I.P., apparently was never <br />submitted to the MLRB. <br />On October 10, 1977, h4obile Premix Concrete, Inc. <br />("MPh4") notified the Adams County Commissioners and other <br />county officials of its purchase of the property and of <br />its desire to comply expeditiously with county and state <br />requirements. <br />A large area of the pit (see map Exhibit C-1) was <br />stripped by Conrock of soil and overburden and pushed to <br />the north property line for storage in a berm some 30 feet <br />6 <br />
