• <br />Section 816.102(c) Continued. <br />(2) Do not restrict normal access; and <br />(3) Are not inappropriate substitutes for lower grades on the reclaimed <br />lands. <br />As stated in response to 30 CFR 816.102 (a), the final topography <br />will consist of simple undulation so that no small depressions will <br />exist. <br />(d) All surface mining activities on slopes above 20 degrees, or on <br />lesser slopes that the regulatory authority defines as steep slopes <br />shall meet the provisions of 30 CFR Part 826. <br />. Kerr Coal will not be mining on any slopes above 20 degrees as <br />shown on Map 34, Kerr Mine Area Premining Topography. Moreover, <br />because the slopes are in the range of 5 degrees to 17 degrees; <br />mining activities will not be subject to the provisions of 30 CFR <br />Part 826. <br />(e) All final grading, preparation of overburden before replacement of <br />topsoil, and placement of topsoil, shall be done along the contour to <br />minimize subsequent erosion and instability. If such grading, pre- <br />paration, or placement along the contour is hazardous to equipment <br />operators, then grading, preparation, or placement in a direction other <br />than generally parallel to the contour may be used. In all cases, <br />grading, preparation, or placement of spoil shall be conducted in a <br />manner which minimizes erosion and provides a surface for replacement of <br />topsoil which will minimize slippage. <br /> <br />816-134 <br />
