As shown on Map 32, Kerr <br />Mine Area Soil Redistribution and Revegetation, the general timetable <br />for reseeding will progress as follows. The final pits within the <br />Marr Mine Area and Pit 1 will be reseeded by the end of 1999; and all <br />haulroads and surface facilities - by the end of 2000. (Contingent <br />upon development of the northern reserve area). <br /> <br />If no additional contracts are secured, shipments of coal from the <br />Kerr Tipple Area could be discontinued by 1993. However, given Kerr <br />Coal's commitment to ongoing marketing efforts, the tipple facilities <br />would be put on a standby basis until all other reclamation <br />activities are completed. If, at that time, Kerr Coal can not commit <br />to future development, and there is no potential for beneficial use <br />of the facilities, Kerr Coal will proceed to remove the facilities <br />and reclaim associated disturbance areas. Under a reclamation <br />scenario, all facilities would be removed from the area, the site <br />would be graded, topsoil would be replaced, and the area would be <br />reseeded. Reseeding of the Kerr Tipple Area would occur using seed <br />mixtures discussed in Section 780.18 during the year 2000. <br />Immediately following the reseeding of any area, soil stabilizing <br />practices as described in Section 816.114, postseeding soil quality <br />testing described in Section 816.25, and the postseeding monitoring <br />plan found in Section 816.116 will be implemented. <br />/'~ Section 816.101 Backfilling and grading: General requirements. <br />(a) Timing of backfilling and grading. <br />(1) Contour mining. Rough backfilling and grading shall follow coal <br />removal by not more than 60 days or 1,500 linear feet. The regulatory <br />authority may grant additional time for rough backfilling and grading if <br />the permittee can demonstrate, through a detailed written analysis under <br />30 CFR 180.18(b)(3), that additional time is necessary. <br />816-127 <br />
