Effluent Limitations - 003 (Cont.) <br />Any discharge or increase in volume of a discharge caused by <br />precipitation within any 24-hour period greater than the 10-year, <br />24-hour event (or series of storms or snowmelt of equivalent volume) <br />comply with the following limitations subject to burden of proof <br />requirements described in Part I.A.2. <br />Flow, MGD - monitoring only per Part I.B.1. <br />pH (standard units) shall remain between 6.5 and 9.0 c/. <br />011 and grease shall not exceed 10 mg/1 c/ in any grab sample nor <br />shall there be a visible sheen f/. <br />Additional conditions - effective at all times: <br />There shall be no discharge of floating solids or visible foam in <br />other than trace amounts. The discharge shall not contain any <br />sanitary wastewaters from toilets or related facilities, or other <br />pollutants not associated with active mining operations. There shall <br />be no land application of wastewater, other than for duet control, <br />• without the previous authorization of a specific discharge point. <br />3. Burden of Proof Requirements - 003 <br />The permittee shall have the burden of proof when requesting relief <br />from total suspended solids (TSS), total iron and/or settleable solids <br />limitations. <br />For rainfall, to waive TSS and total iron limitations, it is necessary <br />to prove that discharge occurred within 48 hours after measurable <br />precipitation has stopped. In addition, to waive settleable solids <br />limitations, it is necessary to prove that discharge occurred within <br />48 hours after precipitation greater than the 10-year, 24-hour storm <br />event. <br />For snowmelt, to waive TSS and total iron limitations, it is necessary <br />to prove that discharge occurred within 48 hours after pond Snflow has <br />stopped. In addition, to waive settleable solids limitations, it is <br />necessary to prove that discharge occurred within 48 hours after pond <br />inflow volume greater than the 10-year, 24-hour event has stopped. <br />The Division shall determine the adequacy of proof. <br />See Part I.C. for Footnotes <br />.
