To address these concerns the applicant submitted a geotechnical evaluation report prepared by Revey <br />Associates, Inc. DMG agrees with the conclusions of the Revey report indicating that the potential for <br />this proposed mining operation to exacerbate the natural spalling of rock from these cliffs is essentially <br />non-existent. A review of the Revey report and follow-up supporting information, submitted in response <br />to citizen comments received about that report, was conducted by DMG staff and is enclosed with this <br />Rationale. <br />13. Comment indicating the applicant's statement that the mine is not expected to have a <br />major affect on wildlife on or near the site is in disagreement with the Division of Wildlife <br />statement. <br />The application contains a statement from the Colorado Division of Wildlife (CDOW) indicating they <br />anticipate this project will have few major impacts on most wildlife. The statement states that there are <br />no species of concern or critical wildlife habitat in the area. This does not appeaz to be in disagreement <br />with statements in the application. Additionally, the applicant revised the reclamation plan to <br />incorporate the CDOW recommendations regarding vegetation species and noxious weed control. <br />14. Comments that reclamation should incorporate the recommendations of the Division of <br />Wildlife that native species should be used in revegetation. That is, restoring the pinyon- <br />juniperplant community should be required <br />The applicant revised the reclamation plan to incorporate the CDOW recommendations regarding <br />vegetation species and noxious weed control. The CDOW statement did not specify that the site should <br />be restored to a pinyon juniper plant community. <br />15. Comments that there are immediate negative impacts and long term hazards. <br />The mining operation will result in immediate impacts to the affected area. Whether or not those <br />impacts aze negative is left to interpretation. DMG staff has not identified any impacts from this <br />proposed mining operation that will result in any sort of long term hazard. <br />16. Comments that plat maps used in the permit are out of date. <br />The permit maps are accurate and provide up-to-date information regazding all adjacent landowners and <br />all structures on or within 200 feet of the proposed affected area. The act and rules do not require the <br />use of plat maps. <br />17. Comments that deer and other wildlife will be displaced <br />Deer and other wildlife maybe temporarily displaced as indicated in the CDOW statement. The <br />applicant revised the reclamation plan to incorporate the CDOW recommendations regarding vegetation <br />species and noxious weed control to improve the wildlife habitat value of the reclaimed site. <br />18. Question about where dust control water will end up. <br />Dust control water is generally applied in a manner whereby it is absorbed into the surface of the roads, <br />facilities area and material being crushed. The sediment control system is designed to filter any <br />drainage that may result from over-application of dust control water. <br />
