Glr.rla.d <br />We represent Peabody Coal Company in water law matters. We have been requested <br />to explain why no water right for Seneca II W Pond 005 is being sought. <br />No beneficial use is presently projected for water from Pond 005. Colorado law <br />provides that a conditional water right may only be obtained for an "appropriation," which ~'~ <br />requires that the water be~placed to a beneficial use within a reasonable time.
