SOx 147 M¢ha<I B. lo~a <br />Fairplay, CO 80440 DIVI510n D1recmr <br />RE: Chaparral Pit (Permit M-95-021 Proposed permitting o£ a <br />contiguous 110 operation by Park County. <br />Dear Mr. Oker: <br />This letter is in response to your request for a statement of the <br />Division's policy regarding Park County's separately permitting a <br />7.7 acre tract of land adjacent to the Chaparral Pit and combining <br />the countyas act].vities in both. <br />There is nothing in the Construction Materials Act or the <br />associated Rules to prevent Park County from permitting two 110 <br />mines side by side. As a matter of fact, Rule 1.11.2 prohibits the <br />conversion of the Chaparral Pit, which was apparently permitted as <br />a 110 in 1995, to a 112 and to include the adjacent 7.7 acre tract <br />in such a 11z permit area until the permit for the Chaparral Pit <br />has been held by the County for two consecutive years. <br />Operations can be conducted by the County simultaneously in both <br />110 permit areas and across the boundary between them so long as <br />both areas are properly permitted, operations in either permit area <br />must, however, confora^, with the conditions of that perr„it. Should <br />there be a difference in the mining or reclamation plans between <br />the two permit areas that conflicts with the County's intended <br />operational plans, approval of an appropriate modificatio)i of one <br />or the other of the permits should be secured. <br />I hope this letter addresses your concerns.
