5
damages are not necessarily a failure oP reclamation but simply a
result of an unfortunate event where a particular degree oP runoff
exceeds the ability of the vegetation to control the erosion. Those
kinds of events are corrected as a part of normal reclamation
maintenance.
Item 3c: Regarding the inclusion of Fringed Sage seed in the seed mix.
RESPONSE: The operator agrees to including 0.1 pound of Fringed Sage Seed in
the seed mixture. Could the Division please provide a list of some
suggested sources Por this seed so when it comes time to do the
seeding the operator can more easily locate a source? MosC standard
seed companies do not carry this seed and refer to it as a s~~eclalty
seed.
Item 4: Regarding the road on the East side oP the permit.
RESPONSE: The Southern end of this road probably will remain, but most of it
will be eliminated after reclamation is completed through the process
of creating the final slope on the East side of the pit.
Items 5 and 6: Regarding reclamation costs and bonding.
RESPONSE: We do not actually have any basis on which to conte:~t your
calculations of the reclamation costs. However, we refer you to our
response to the "Special Note" for Exhibit D. IP such a cost
adjustment is possible under the arrangement proposed, then the
operator is very willing to discuss such an arrangement.
EXHIBIT G:
Regarding legal right to enter.
RESPONSE: Anew legal right to enter signed by the landowner, is attached.
