<br />sand and =ravel and related products (but not precious minerals), and for the placement and use of <br />crushers and other equipment used in connection with the extracting, hauling, processing, and <br />stockpilin_ of the sand and gravel and related products (but not precious minerals). GJP may realign <br />' any existing roadways on the Property, and create other roads on the Property, as necessary for its <br />' operations, for hauling sand and gravel from the Property, and for general access to the Property. <br />' Iu planning its miming activities on the Property and the roads which it will create or realign, GJP <br />shall consult with Lessor in order to develop a layout of the pit mea and of the roads which will be <br />! satisfactory to Lessor. GJP's mining activitizs shall be restricted to the portion of the property shown <br />1 as the "Minim Area" on [he map attached hereto as Exhibit B GJP shall also consult with Lessor <br />in developing a reclamation plan for the Property. Lessor agrees that any layout of the pit area must <br />be such that it will allow GJP to zconomically mine sand and gravel from the Property: and that any <br />reclamation plan developed for the Pt'operry trust be economically fzasible and generally consistent <br />•.~ ith reclamation plans adopted for other similar pits in the Nfesa County area, GJP shall also install <br />a fence and, where necessary, cattle wards, across and along both sides of am• rzaligned or newly <br />' created roads on the Property acrd around the portion of the D4ining Area where mining is taking <br />' place and where the stockpiles are located, to ]:eep Lessor's livestock from entering these areas. The <br />fence shall bz of a type mutually agreed upon by the Lessor and GJP; provided that if the parties <br />cannot agree as to the type offence; the fence shall be a "lawful fence" as defined in §3.-46-101(1), <br />C.R.5. <br />2. GJP shall proceed with due diligence to apply for all governmental permits necessary <br />to conduct its operations on the Property under this Lease.
