Road 711.2 - Dry Fork of ;Minnesota Creek Road. <br />Forest Devel.opmenC Road 711.2B - Apache Rocks Road. <br />The non-system e:<ploratior. road which junctions with Che Apache Rocks Road <br />and goes in a generally easterly direction to West Flati~,-on is not open to <br />public,full-size vehicular traffic, but is necessary for continued <br />activities associated with coal mining in the West Flat Iron area. <br />All three of these roads are granted exceptions. <br />Fox the purpose of: <br />The management of wetlands and floodplains are subject to Executive Orders. <br />11990 and 11988, respectively- The purpose of the EO's are to avoid to the <br />extent possible the long and short term adverse impacts associated with the <br />destruction .or modification of wetlands and floodplains and to avoid direc[ <br />or indirect support of new construction in wetlands wherever~Chere is a <br />practical alternative. <br />.91so, it is recognized .that there is a direct relationship betoreen impacts <br />ion such areas and effects on water duality and aquatic ecosystems. There <br />is a high ri:~k of.:irreversible and irretrievable impacts on the latter with <br />operation and deve:Lopments in wetlands, floodplains and riparian areas. <br />:Ct may become necessarj for a waiver, exception or modi:ication (WF2f) to <br />this stipulaticn for the operator/lessee to use the surface in the area <br />covered by this stipulation to allow for the recovery of the coal reserve.i <br />IJEM's to this stipulation will be considered only at the time operations~~ <br />:ire proposed, and will be subject to the Forest Land and. Resource <br />lianagemenc Plan in effect at~the time of consideration, and will be subject <br />to applicable regulatory and environmental complianr_e requirements. <br />(:ranting of a WEM is a Forest service discretionary ~,eetion which the <br />operator should not rou[inely expect. The Forest Service te:serves the <br />x:ight to impose other stipulations in the same area of th:Ls leasehold if a <br />LIEM is granted. <br />Conditions under which a I7E:f may be granted: <br />I:f it can be shown through environmental analysis and the application of <br />mitigation measures that the impacts to wetland, floodplain and riparian <br />resources wi'L1 be minimized and that no other alternative location for <br />facilities and activities associated with coal mining. is practical because <br />of environmental effects and operational considerations (eg, economics, <br />health and safety, etc.). <br />Any changes to this stipulation will be made in accordance with the land use <br />plan and/or the regulatory provisions for such changes.
