Serial No. C-56447 <br />CONTROLLED SURFACE USE STIPULATION <br />2IG GA?fE WINTER RANGE <br />• , <br />Surface occupancy or use is subject to the following special operating <br />constraints. <br />Operation and maintenance of facilities associated with coal mining such as <br />roads, waterlines, water tanks, powerlines, ventilation shafts, ancillary <br />buildings, and including monitoring will be scheduled to minimize adverse <br />effects on trig game (elk) from December 1 to April 30. Unscheduled use <br />will be allowed in emergency situations with notice and coordination with <br />the Forest Service. <br />Limit road use to periods when animals are not present on the winter <br />range. Restrict road use to personnel associated with operation and <br />:maintenance, of coal mining facilities. Aecontour and revegetate to prior <br />existing con<iitions (to extent possible) new roads when work is. complete. <br />On hands describf:d below: <br />:Portions of Sec. 14, 22, 23, and. 26, T.13S:, R.90W., 6th PM with winter <br />range for big game(elk) as generally delineated on the attached map dated <br />3-8-95. The map is for planning purposes only. The existence: of big ,game <br />winter range on the giound will determine whether the stipulation applies. <br />In the event o£ any conflict between written clauses of this stipulation <br />and the map, the stipulation clauses shall control. All National 20 rest <br />..">ystem Land within the leasehold which is classified as big game winter <br />r. ange for elk falls under jurisdiction of this stipulation. . <br />For the purpose aF: <br />1'rotecting~ big game winter range 'for elk. These ranges are extremely <br />_mportant for animal survival during winter. Disturbances. and habitat <br />losses may glace unnecessary stress on the wintering wildlife herds and <br />cause an increase in herd mortality. <br />]:t may become necessary for .a waiver, exception or modification (WEH) to <br />this stipulation for the operator/lessee to use the surface in the area <br />covered by this stipulation to allow for the recovery of the coal reserve. <br />6rEM' S to this stipulation will be considered only at the time operations <br />are proposed, and will be subject to the Forest Land and Resource <br />Management Ylan in effect at the time of consideration, and will be subject <br />to applicable regulatory and environmental compliance requirements. <br />Granting of a WEDS is a Forest Service discretionary action which the <br />operator should not routinely expect. The Forest Service rr_serves the <br />x'ight to impose other stipulations in the same area of this leasehold if a <br />G'F1i is granted, <br />Anp changes to t;iis stipulation will be made in accordance with the land use <br />plan and/or the regulatory provisions for such changes.
