In order [o <br />comply with the minimum requirements of the Act and/or the Mineral Rules and Regulations, the <br />following items need to be addressed: <br />1) Rule 6.2.1(2)(d) -stipulates that the maps must identify and outline the area which <br />corresponds with the application. Either the maps aze incorrect or the legal description for the lasl <br />leg of parcel #2 survey is wrong. As described in Exhibit A, survey closure occurs between <br />Station Markers #L2 and #1. However, the maps show closure from Station Marker #12 to <br />Station Marker #2 to Station Mazker #1 (Markers #1 and #2 are part of parcel #1 survey) or from <br />Station Marker #12 to a point between Markers #1 and #2. If the legal description is correct, the <br />maps will have to be redone. L` the maps aze correct, the legal description for pazcel #2 will have <br />to be revised. If either revision increases or decreases the permit acreage then the application will <br />need to be revised to reflect the corrected permit area. <br />~~ 2) Rule 6.3.1 -This Exhibit is okay except, possibly, as noted above. <br />6 <br />3) Rule 6.3.3(d) -You need to specify the thickness (approximate) of the waste piles. <br />4) Rule 6.3.3(8) -You state that "culvert(s) installation may be necessary to insure that mining <br />equipment does not operate in wet ground conditions." If you install a culvert, or culverts, you <br />~~ need to provide sufficient information so that the Division can evaluate structure sizing. Also, <br />you need to contact the Corp of Engineers to see if a 404, etc., permit is required. <br />5) Rule 6.3.3(h) -You need to specify how much water will be used in conjunction with the <br />~~L_ opera ion (for dust control, or product washing), and the source of this water. <br />6) Rule 6.3.3(j) - If groundwater or surface water is intercepted or disturbed you need to <br />
