Cattany <br />Division Director <br />Natural Resource Trustee <br />DMG has completed technical review of the application fora 112c Regular Operation Reclamation Permit <br />and the amendment to that application for the Benson Brothers Red Shale Pit. DMG believes that the <br />applicant has complied with the minimum requirements of the Construction Materials Act and Rules <br />specifically the requirements of Section 34-32.5-115(4). The Division is preparing to recommend approval <br />of the application over objections to the Mined Land Reclamation Board at their May 10-11, 2006 Board <br />meeting. DMG's rational for the approval recommendation is enclosed. <br />A Pre-hearing Conference has been scheduled to occur on Aari125, 2006, beginning at 1:00 p.m., at the <br />Cedaredge Community Center, 140 NW 2ntl Street, Cedaredge, Colorado. Ms. Sandy Brown will preside as <br />Pre-hearing Conference Officer. <br />The application will be considered by the Mined Land Reclamation Board during a Formal Public Hearing <br />scheduled for May 10-11, 2006.
