DMG has completed technical review of the application fora 112c Regular Operation Reclamation Permit
and the amendment to that application for the Benson Brothers Red Shale Pit. DMG believes that the
applicant has complied with the minimum requirements of the Construction Materials Act and Rules
specifically the requirements of Section 34-32.5-115(4). The Division is preparing to recommend approval
of the application over objections to the Mined Land Reclamation Board at their May 10-11, 2006 Board
meeting. DMG's rational for the approval recommendation is enclosed.
A Pre-hearing Conference has been scheduled to occur on Aari125, 2006, beginning at 1:00 p.m., at the
Cedaredge Community Center, 140 NW 2ntl Street, Cedaredge, Colorado. Ms. Sandy Brown will preside as
Pre-hearing Conference Officer.
The application will be considered by the Mined Land Reclamation Board during a Formal Public Hearing
scheduled for May 10-11, 2006. The May 10-11, 2006 Board Meeting will occur at 1313 Sherman Street,
Room 318, Denver, Colorado, beginning at 10:00 A.M., or as soon thereafter as the matter can be
considered.
