I am sending you three items of information, Two of the items we discussed <br />over the telephone and a third item is submitted to show receipt of the mailing made to <br />the telephone company easement holder. <br />Acreage Calculations. The question was asked whether it was the actual intend of the <br />most recent information to change the permitted disturbance acreage from 24.89 to <br />25.21 acres. The answer to this question is no. The slightly higher figure was calculated <br />based on somewhat different assumptions for the haulroad disturbance. In order to <br />clarify the fact that we are still proposing the identical disturbance as proposed in our <br />24 June 1998 Permit Application, we have clarified this fact and are enclosing revised <br />pages 4, 27 and 28 where a different figure for the haulroad disturbance was used. The <br />actual disturbance associated with the haulroad is 0.45 acres. We errored in our most <br />recent calculations by including portions on the top of the ridge which are part of the <br />exiting ranch road and which will not need to be reclaimed. <br />Proof of Filing With the Routt County Clerk and Recorder's Office. Attached you will <br />find a receipt acknowledging their receipt of this revised permit application package and <br />technical adequacy responses. This receipt has been added to the revised page 36 <br />entitled "Proof of Filing With the County Clerk and Recorder." We want to inform the <br />DMG that copies of the three revised pages mentioned above and that mentioned in the <br />next section have been added to the copy of the Permit Application filed with the Routt <br />County Clerk and Recorder's office. <br />Proof of Receiat of Mailing to US West Communications. We are also enclosing the <br />signed return receipt mailing from US West Communications, one of the utility <br />easement holders in this area. <br />Decision of the DMG to Deem Our Responses to the Technical Adeauacv Letter as <br />a Technical Revision. We understand in talking to Ms. Crosby of your office, that the <br />DMG has determined that our responses to the issue of mining next to the natural gas <br />pipeline and the issue of the potential impacts to the Anderson's water well have been <br />viewed to constitute a possible "technical revision" or "Amendment" by the DMG. We <br />are very confused regarding this matter since we have not changed anything with <br />respect to our mine plan or our reclamation plan and our position is that the information <br />we submitted constitutes only a "clarification" to technical adequacy issues and that we <br />
