See C.R.S. § 37-90-137(11)(a)(I), § 37-90-137(2)(b)(I), and <br />§ 34-32.5-116(4)(h). See also Section 3.1.6 of the MLRB Construction Materials Rules and <br />Regulations. <br />Based on the above-cited authorities, the Mined Land Reclamation Board clearly has <br />authority to consider groundwater impacts such as those of concern to the Wilson Farms group. <br />Thus, the Wilson Farms group respectfully requests that issues relating to these groundwater impacts <br />be fully considered and thoroughly addressed in the process for determining whether the requested <br />permit should be granted. <br />The issues raised in this letter are based on the Wilson Farm group's present <br />understanding ofthe impacts posed by the permit application. The Wilson Farm group reserves the <br />right to raise additional issues as more information is revealed. Also, the number of persons or <br />entities in the group may change as this matter progresses. <br />Thank you for your attention to these matters. I expect that Iand/or representatives <br />of the Wilson Farms group, along with Forrest Leaf, water resources consultant, will be attending <br />the informal conference, pre-hearing, and hearing in this matter.
