<br />RIDER TO MINING PERMIT <br />Permit Date; January l 1, 1999 <br />Permit No: M-97-054 <br /> <br />The following additional stipulations and conditions form an integral part of the foregoing permit: <br />Stipulation No. Description <br />The operator will monitor two spring sources on asemi-annual basis for flow rate fluctuations. If a <br />significant flow tote decrease is observed which is above 20°6 and not associated with a dry season for <br />the region, the operator must investigate the cause of the drop in flow rate and repott it's Endings to <br />the Division. Two monitoring wells must be measured for static water elevation on a semi-amual <br />basis. Any significant drop in static water elevation or flow rates must be investigated and a report <br />of the ttaults be ptorttpdy submitted to dte Division. Semi-atmttal measurements must be in the Annual <br />Repot. <br />To address the potential contamination concerns from chemical methods for weed control used by the <br />operator, water quality tests will be conducted along with the monitoring of the wells and springs <br />provided for in this stipulation. The Division of Minerals and Geology will develop for the operazor <br />a list of the water quality parameters the operator witl be required to test. <br />2. The betnonite clay litter of the fuel storage area will be compacted to a permeability of 1 x 10.6. The <br />results of 4 evenly spaced perteability tests of the liner performed by a certified geotechmical engineer <br />must be reviewed and approved by the Division prior to the gravel liner being placed. <br />3. Any significant fuel spills outside the conrninment area will be reported to dte Division within 24 <br />hoots. Agile Stone Systems will send to the Division, as soon as practicable, a repot on the mitigation <br />of any potential pollution of the gourd water system due to the spill. <br />4. In dte same manner as provided for the quantity and quality testing of the 2 (two) springs defined m <br />Stipulation No. 1, the operator shall test the Mark N. And Jacque Brown/Robert and Susan Steers <br />spring east of County Road ]57 on a bi-annual basis, provided the owners and users of the spring <br />provide sufficiem reasonable access to do the sampling for the water quality test. <br />MINED LAND RECLAMATION BOARD <br />COLORADO DEPARTMENT OF NATURAL RESOURCES <br />MICHAEL B.
