Cottony <br />Division Director <br />Natural Resource Trustee <br />Re: Response to counts concerning the Wattenberg Lakes, Aggregate Industries-WCR 112c Reclamation <br />Permit Application ,File No. M-2004-051 <br />Dear Mr. and Ms. Baurer: <br />In response to your letter, received by our office on September 7, 2004, the Division of Minerals and Geology <br />(DMG) is providing you with the following information: <br />Your first'and second concerns are in regard to water table draw downs and the impact of slurry walls on the <br />hydrology. The DMG has reviewed the permit application as part of its adequacy review process, and has asked <br />the applicant to address the issue of impacts on area wells and groundwater levels and what measures will be <br />taken to insure that such impacts will be minimized. We are enclosing a copy of the DMG's adequacy review <br />for your information. <br />In reference to your concems about noise and visual impacts, the Division does not have any authority to <br />regulate these concerns under the Construction Materials Rules and Regulations or the Colorado Land <br />Reclamation Act for the Extraction of Construction Materials. You may wish to contact Weld County to see if <br />they have any jurisdiction over these issues. <br />The Division may have some authority over the dust and blowing sand and bentonite to the extent that the <br />operator is required to control erosion on the site, but these issues may possibly be better addressed by the Air <br />Quality Division of the Colorado State Department of Health and Environment. <br />The Division does require the applicant to show that they have a legal right of access, and the Division can <br />enforce many off site impacts to adjacent properties, but does not have the authority to regulate property right <br />or access ussues. <br />C/ <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geological Survey <br />
