Permit No:CO-0027154 <br />• A.. :MANAGEMENT <br />~~~.~~~-a~. r ~~~:•'~.1. ~ Change <br />REQUIREMENTS <br />in Discharge <br />All discharges authorized herein shall be consistent with the terms <br />and conditions of this permit. The discharge of any pollutant <br />~~--- ~ identified in this permit .core frequently than or at a level in <br />excess of that authorized shall constitute a violation of the permit. <br />Any anticipated change in discharge location, facility expansions, <br />production increases, or process modifications which will result <br />_ in new, different, or increased discharges or pollutants must be <br />reported by submission of a new NPDES application or, if such changes <br />will not violate the effluent limitations specified in this permit, <br />by notice to the State Water Quality Control Division of such changes. <br />Process modifications include, but are not limited to, the introduction <br />of any new pollutant not previously identified in [he permit, or any <br />other modifications which may result in a discharge of a quantity or <br />quality different from [hat which was applied for. Following such <br />notice, the permit may be modified .o specify and limit any pollutants <br />not previously limited. <br />.~-..___ L~=3~r.' Noncompliance <br />(A) Definitions <br /> (1) Upset: An exceptional incident in which there is unintentional <br /> and temporary noncompliance with technology-based permit <br />• effluent limitations because of factors beyond the reasonable <br /> -___ <br />. control~of-.the permittee. <br /> -~''(2) Bypass: The intentional diversion of waste streams from any <br /> portion of a treatment facility. <br /> (3) Severe Property Damage: Substantial physical damage :o property, <br /> to the treatment facilities to cause Chem to become inoperable, or <br /> substantial and permanent loss of natural resources which can <br /> reasonably be expected to occur in the absence of a bypass. I[ <br /> does no[ mean economic loss caused by delays in production. <br /> _s-(B) Noti fication <br /> (1) If, for any reason, the permittee does not comply with or will be <br /> unable to comply with any maximum discharee limitations or <br /> standards specified in this permit, [he permittee shall, at a <br /> minimum, provide the Water Quality Control Division and EPA with <br /> :he following information: <br /> a) A description of the discharee and cause of noncompliance <br /> b) The period or noncompliance, including exact dates and times <br /> and/or [he anticipated time when [he discharge will return to <br /> compliance; and <br />• c) Steps being taken [o reduce, eliminate, and prevent recurrence <br />of the noncomplying discharge <br /> . <br />1/91 <br />
