Mr. Thompson monitored all <br />phases of construction on a regulaz basis under the direction of Mr. M`Giothlin who was <br />also present during various phases of construction. <br />This inspection was conducted as required by Section 4.05.6 of the Regulations of the <br />Colorado Mined Land Reclamation Board for Coal Mining. This is a follow-up <br />certification to the original certification of February 6, 2002. The purpose of this <br />recertification is to more clearly reference the applicable design plans for this pond and <br />the regulations requiring this certification, and any material modifications, if any, as <br />noted above. <br />I HEREBY CERTIFY THAT POND 008 WAS CONSTRUCTED IN ACCORDANCE <br />WITH THE ABOVE REFERENCED DESIGN PLANS. FIELD MODIFICATIONS, AS <br />MAY BE NOTED ABOVE HAVE NOT ADVERSELY IMPACTED CRITICAL <br />DESIGN CRITERIA FOR POND VOLUME, AND EMBANKMENT AND <br />EMERGENCY SPILLWAY DIMENSION.
