During your 1/16/98 visit to the DMG Durango Office, DMG denied you access to the
information contained within Notice of Intent to Conduct Exploration file.
Rule 5.2 of the Construction Materials Rules and § 34-32.5-113(3), C.R.S., states that X11
information provided in a Notice of Intent to Conduct Exploration shall be protected as
confidential information and shall not be a matter of public record in the absence of a
written release from the operator.
DMG has not received a written release from the operator for the file which you requested
to review.
Please find enclosed, copy of 12/31 /97 fetter from agent, Douglas L. Conger, responding
to DMG 12/22/97 "RTB" letter. During your 1/16/98 visit, you had reviewed this letter and
had requested a copy.
