Banks and Gesso, LLC <br />Exhibit M -Other Permits and Licenses <br />Town of Windsor Rezoning and Annexation <br />An application for annexation is in process with the Town of Windsor, Colorado. <br />Flood Hazard Area Development Permit <br />If required, an application for a Flood Hazard Area Development Permit will be submitted <br />to Weld County or Town of Windsor (as appropriate) and approved prior to disturbance. <br />CDPS State Discharge Permit/Stormwater Permit <br />Prior to any ground-disturbing activities at the proposed permit area, a <br />CDPS/Stormwater Permit will be obtained from the Colorado Department of Public <br />Health and Environment (CDPHE) that will account for all off-site discharge and will <br />contain a plan for control of that discharge. <br />Air Permits <br />Prior to any ground-surface disturbing activities (topsoil removal and stockpiling, access <br />road development, haul road construction or material hauling) or processing activities <br />(crushing, screening), the Applicant will obtain Construction Permits from the CDPHE. <br />These permits will be kept active during the entire life of the mine. <br />Road Access and Maintenance Agreements <br />The applicant is working with Weld County Public Works regarding County Road 64 <br />access and improvements. <br />Substitute Water Supply Plan (SWSP)/Gravel Pit Well Permit <br />A SWSP and Gravel Pit Well Permit will be obtained from the State Engineer's Office <br />prior to exposing groundwater. <br />State Historic Preservation Office <br />The Colorado Historical Society (CHS) records indicate that no historic and cultural sites <br />and no surveys were located on the property.
