The maximum fill of the crossing <br />would be 5 to 6 feet at the road crown. From this analysis the <br />road would involve placement of less than 200 cubic yards of fill <br />within less than 0.1 acres of the estimated Willow Creek 100-year <br />floodplain at the crossing point. <br />We respectively request a determination from your office <br />regarding the appropriate Clean Water Act Section 404 permit <br />action. Specifically, we are interested in your conclusions with <br />regard to the various exemption provisions of 33 CFR, Part <br />323.4A6 referring to construction of mining haul roads. If it is <br />your finding that no particular exemption is applicable we <br />request a Nationwide permit be issued for this activity. There <br />are no other associated impacts from this operation. Best <br />management practices and guidelines will be utilized for the <br />crossing. <br />Terry, thank you for your help and attention to this matter.
