L.G. Everist, Inc. (LGE) will Commit that no mining, reclamation or slurry wall construction will take place <br />within 200 feet of any permanent man-made structure (not owned by LGE) until all required signed and <br />notarized agreements/waivers are submitted and approved by the Division of Minerals and Geology <br />(DMG). <br />Enclosed is a signed and notarized copy of another one of the agreements required, which we just <br />received from the Lupton Bottom Ditch Company. <br />2. LGE will not commence slurry wall construction until the DMG is in receipt of our Ouallry Assurance and <br />Quality Control (QA/UC) plan that will be designed and certified by a Colorado registered engineer and <br />further approved by the Office of the State Engineer (SEO). <br />3. LGE will blend the overburden and shale on the site for the reconstructed Lupton Bottom embankment in <br />a lift pattern as shown on the attached sketch. We will also compact the material to a minimum 95% <br />Proctor density and perform this test either twice per day or twice per compacted lift. Clarifying our letter <br />of April t 8, we will control the embankment moisture as the soils require for Utat minimum density. LGE <br />will also adhere to industry standards for compaction as lhey relate to grain distribution and permeability. <br />LGE will provide the DMG with all soil test results either in the annual report or upon request. <br />4. We request that you include in our bond the construction cost of a concrete ditch liking which will be <br />roughly 1150 feet tong, 17 000 square feet, or 200 cubic yards of in-place concrete. We estimate 5300 <br />per Cubic yard to put this lining in place. <br />If you have any questions or concerns regarding this response, or if anything else is required for adequacy, <br />please contact me or Rick Everist immediately.
