t <br />~ , • III III III III IIII III • <br />AGREEMENT <br />This agreement entered into by Mario Zadra, Norwood, <br />Color-ado, herein referred to as the "landowner", and San Miguel <br />Couni_y, herein referred to as "the County". <br />Whereby, the landowner agrees to sell to the County raw <br />gravE:l material located in the NW 1/4, NW 1/4, Section 32, <br />T43N, R12W, for a price of g.35 per cubic yard, with no minimum <br />or maximum amounts of gravel to be removed during the term of <br />this agreement. The landowner agrees to allow the County <br />unre~:tricted access to said material and property for the <br />purpose of removing pit run material, crushing, screening and <br />stockpiling for a period of five (5) years from the date of <br />this agreement. In the event the landowner chooses to accept <br />crushed gravel in lieu of payment, the cost will be based on <br />the County's actual cost to prepare and haul said gravel, with <br />no profit included. <br />The landowner agrees to release the County from all <br />liability for personal injury or property damage that may occur <br />as a consequence of the County's activities or due to the <br />presence of the County's employees on the owner's premises, <br />unless due to willful fault or neglect on the part of the <br />County. <br />In exchange, the County agrees to remove and stockpile the <br />top soil. At which time the area is to be reclaimed, the <br />slopes will be recontoured to a 3:1 ratio. The top soil will <br />be spread evenly over the affected area and reseeded upon <br />recommendation of the Soil Conservation Service (SCS). <br />The County agrees not to disturb more than 10 acres. <br />The County agrees to obtain all necessary permits. In the <br />event that any permits are denied, this agreement will become <br />void. <br />The County agrees to place a temporary cattle guard on the <br />property line where the pit access road leaves County Road 46M <br />and enters private property. At the time the gravel pit is no <br />longer used by the County, the cattle guard will be removed and <br />the fence or gate will be rebuilt in the location of the cattle <br />guard, to equal or exceed its existing condition. It is <br />understood that the access road is to be locked at all times <br />when not in use. <br />Exhibit F <br />
