The <br />Division of Minerals and Geelogv (Division) is required to make an approval or denial decision <br />no later than March l7, 1999, therefore. your response to the following adequacy review <br />concen:s should be submitted to the Division as soon as possible. If you feel more time is <br />needed to complete your reply, the Division can grant an extension to the decision date. This <br />will be dome upon receipt of a written waiver of your right to a decision by March 17. 199 and <br />request for additional time. 1-his must be received no later than the deadiine date. <br />1. As required by Rule 1.6.E (2), please submit the proof of publication of the public notice <br />circulated in the local newspaper. Proof of notice may be return receipts of a Certified <br />Mailing or by proof of personal service. <br />2. Please be advised that yott may need a Stormwater Permit from the Colorado Department of <br />Public Health and Environment, Water Quality Control Division. If any storm water control <br />structures aze required to be constructed at the mine site as a result of the storm water <br />permitting process, the operation and reclamation aspects of such structures must be included <br />in the Reclamation Permit. <br />The permittee depicts the Templeton Ditch running directly through the permit area. On the <br />north portion of the mine (Phase I), the top of the pit is 15 feet from the Templeton Ditch. <br />On the south portion of the mine (Phase [I & [II), the pit is only 3 feet from the Templeton <br />Ditch. The applicant states that the ditch will be lined with cobble or an appropriate lining to <br />avoid erosion and seepage of the ditch. <br />
