AA~OGCl1 ISSUANCE OF 7HIS PERMIT DOES NOT CONFER A WATER RIGHT Page 1 of 2 CONDITIONS OF APPROVAL 1) This welt (hereinafter "gravel pit pond") shalt be used in such a way as to cause no materiel injury to existing water rights. The issuance of this permit tloes not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civil coun action. 2) The construction of this gravel pit pond shalt be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in accordance with Rule 18. 3) Approved pursuant to CRS 37-90-137 (2) and (11) for the construction and operation of a gravel pit pond exposing and diverting ground water tributary to the Animas River at a point where water is available for appropriation. This gravel pit is known as the Upper Animas Sand & Gravel Pit, Division of Minerals and Geology permit no. M-2005-065. 4) The approval of this permit does not grant a water right. This gravel pit pond is subject to administration by the Division Engineer in accordance wKh applicable decrees, statutes, rules and regulations. 5) The pumping rate shall not exceed 100 GPM during gravel mining operations. No pumping shall oxur after gravel mining operetiona are completed. 6) The average annual amount of ground water to be appropriated shall not exceed 10.69 acre-feet during gravel mining operations, and 5.63 acre-feet after gravel mining operations are completed. The total surface erea of the proposed ground water pond is limited to 4 acres. 7) During gravel mining operations the use of ground water is limited to evaporation off the gravel pit pond surface, crushing, screening and washing of mined product, water lost in the mining of product, and dust suppression. Upon completion of gravel mining operations the use of ground water is limited to evaporation. No other use of water is allowed unless a permit therefor is approved. W ater from this well shall not be used for human consumption whhout separate approval from the Board of Examiners of Water Weil Construction and Pump Installation Contractors. 8) The owner shalt mark the gravel pit pond in a conspicuous place with well permit number(s) and court case number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings. 9) Pursuant to Rule 10.1.6 of the Water W ell Construction Rules, gravel pit wells are exempt from the minimum well construcion standards except for contamination considerations as stated in the Rule. The owner of the gravel pit shall take necessary means and precautions tc prevent contaminants from entering the gravel pit well. 10) Pursuant to Rule 17.1.4 of the Water Well Construction Rules, the owner shall submit, after initiation of construction, site plan and cross section drawings on B-1/2" x 11" paper showing the extent of intended excavation, the maximum depth of the pit, and the initial static water {evel. 11) The boundaries of the gravel pit pond shall be more than 600 feet from any existing well, completed in the same aquifer that is not owned by the applicant.
