Exhibit E -Reclamation Plan <br />5) A full analysis of hydrological concerns, and the information required to address the <br />Division's concems regarding groundwater and surface water at the site, has been done by <br />Tom Schreiner of the Division (Attachment 1). These issues must also be resolved prior to <br />approval of this application by the Division, in accordance with Rules 3.1.6 and 3.1.7 of the <br />Construction Materials Rules and Regulations. <br />6) No details about the construction of the liner, its installation, or the quality control measures <br />to be taken during the process of installing it have been furnished. Please submit these details, <br />in accordance with Rule 6.4.5(2)(a) of the Construction Materials Rules and Regulations. See <br />item number 10 of Tom Schreiner's review, also. <br />7) In accordance with Rule 6.4.5(2)(d), please specify what quantity of wheatgrass, and what <br />species, will be used to seed the topsoil stockpiles, should they be left in place more than one <br />growing season. <br />8) The suggested seed mixes are both low in their pounds of Pure Live Seed per acre, and show <br />an unusually high percentage of wheatgrass species. The percentages cited on page 8 for the <br />mixes aze erroneous (the correct percentages are: 30% Vaughn Side Oats Grama, l 1% <br />Grenville Switchgrass, 6% Covington Blue Grazna, and 52% Barton Westem Wheatgrass; <br />and 40% Barton Western Wheatgrass, 44% Luna Pubescent Wheatgrass, and 16% Lincoln <br />Smooth Brome). Please reconsider these seed mixes in light of the need to establish a <br />"diverse, effective, and long-lasting vegetative cover that is capable of self-regeneration <br />without continued dependence on irrigation, soil amendments or fertilizer, and is at least <br />equal in extent of cover to the surrounding area." The average Pure Live Seeds per square <br />foot should be around 40 PLS/fr' for drilled seed, or 80 PLS/fr' for broadcast seeds. Also, <br />please specify what the spacing of the clusters of trees and shrubs per acre will be, as well as <br />the percentage survival after a certain amount of time. This is in accordance with Rule <br />3.1.10(1) and 6.4.5(2)(f)(ii) of the Construction Materials Rules and Regulations. <br />9) Please commit to not exposing any groundwater until after the Office of the State Engineer <br />(OSE) approves the Substitute Supply Plan. In case of the accidental exposure of <br />groundwater during this time, please commit to backfilling the exposed water to 2' above <br />water table, and notifying the OSE and DMG immediately. See item number 9 of Tom <br />Schreiner's review, also. <br />Exhibit S -Permanent Structures <br />10) "Where the mining operation will adversely affect the stability of any significant, valuable, or <br />permanent man-made structure located within two hundred (200) fee[ of affected land, the <br />applicant may either provide a notarized agreement between the applicant and the person(s) <br />having an interest in the structure, that the applicant is to provide compensation for any <br />damage to the~structure; or where such an agreement can not be reached, the applicant shall <br />provide an appropriate engineering evaluation that demonstrates that such a sttucture shall <br />
