6.4.12 Exhibit L -Reclamation Costs <br />Based upon our calculations, the actual size of any stockpile holding overburden materials will be <br />no larger 343,000 CY. The average haul distance of 1000 feet is acceptable. <br />Disposing of the entire amount of excess overburden on site in the manner described will create <br />approximately 11 more acres of surface area for reclaimed land that will need topsoil. <br />Approximately 4 additional acres will be created in Area Two, and another 7 acres will be created <br />in Area Three. <br />6.4.19 Exhibit S -Permanent Man-made Structures <br />In addition to the structure agreements already submitted to your office, agreements with the <br />appropriate oil and gas operators on the site are in the works that will allow mining closer than <br />200' to those pipelines. Once those agreements are finalized, copies will be forwarded to your <br />office for your review. In lieu of those agreements, Owens Brothers will maintain 200' setbacks <br />from the pipelines. <br />Enclosed you will find a Slope Stability Analysis (SSA) performed by our office for mining within <br />200' of the overhead utility lines (owned by United Power) that border the property on the south. <br />The SSA indicates that a setback of 90' from the power poles will be sufficient. Only one SSA <br />was performed, the assumption being that if the SSA was acceptable for the closest structure, it <br />would be acceptable for those farther away as well. <br />One last note we would like taken into account, however, is that in past dealings with United <br />Power, we have been able to reach agreements based on their in-house policy that allows mining <br />to occur much closer than the SSA shows would be acceptable. We ask the division to consider <br />this and accept the 90' setback from the power lines as sufficient until such time that a final <br />agreement with United Power can be reached that will allow mining within that setback. <br />It is my hope that the above provided information, coupled with the attachments, will successfully <br />address the Divisions concerns regarding the Nix Sand and Gravel Mine.
