<br />Letter to Jerry Worthley <br />Page 2 <br />U.S. Army Corps of Engineers <br />Southern Colorado Project Office <br />720 North Hain Street, Suite 205 <br />Pueblo, CO 81003-3046 <br />719/543-9459 <br />It ie my understanding that you will need to submit your concerns/request <br />to the COE in writing, and that you will have a defined timeframe in which to do <br />this, once the dredge and fill permit application ie filed. Hs. Culp can notify <br />you of the filing date and the timelines for submitting your comments. in <br />conjunction with the dredge and fill permit, my agency will undertake an <br />antidegradation analysis and certify that the quality of the water will or will <br />not be adversely affected by the proposed mining operation. <br />My consultations with WQCD hydrogeologiete and with the DHG indicate that <br />the applicant hoe taken the steps needed to minimize the impacts to water quality <br />from the proposed gravel mining and processing operation. The WQCD will continue <br />to monitor the operation through the discharge monitoring reports that will be <br />filed on a scheduled basis; the DMG will address water quality considerations in <br />the reclamation permit. <br />You may be aware that the DMG will conduct a prehearinq conference on the <br />Agile Stone Syeteme permit application on Monday, Harch 16th, at 1:00 p.m. in the <br />Canon City Council Heetinq room located at 612 Aoyal Gorge Boulevard in Canon <br />City. This would be a convenient opportunity for you to raise your concerns <br />prior to the public hearing on the permit. I am enclosing a copy of the <br />announcement for the conference for your reference. If possible, I would also <br />encourage you to attend the public hearing on the permit scheduled before the <br />Hined Land Reclamation Board on March 25th or 26th, 9:00 a.m. nt 1313 Sherman <br />Street in Denver. Me. Glenda Williams develops the Board's agenda and will be <br />able to tell you; after Harch 20th, which day the hearing will be held. She can <br />be reached at 303/866-3567. <br />I understand your concern about the impacts an your well and your property, <br />and e:o hopeful that they can be addressed in a satisfactory manner through the <br />state and federal permitting processes. I hope that this letter adequately <br />explains the measures taken by the state permitting agencies to protect the <br />integrity of the water.
